General Terms and Conditions

1. General

1.1 The client agrees with Althof Consulting- und HotelbetriebsgesmbH, hereinafter referred to as “Althof Retz”, that these General Terms and Conditions of Contract shall apply exclusively to this and all future bookings. Any conflicting contractual or business terms and conditions shall require a separate agreement.

1.2 The reservation of guest rooms and the agreement of other services and deliveries shall become binding for both parties to the contract upon written confirmation by Althof Retz. Offers are always subject to change.

1.3 In the event of discrepancies between a verbal order and a written order or written order confirmation from Althof Retz, the latter shall prevail.

2. Prices

2.1 The prices quoted are inclusive of taxes and duties.

2.2 Any increase in the VAT rate after conclusion of the contract shall be borne by the customer.

2.3 If the period between conclusion of the contract and provision of the service exceeds 6 months, Althof Retz reserves the right to make price changes.

3. Payment

3.1 Unless otherwise agreed in writing, the client shall pay the contractually agreed fee to Althof Retz without any deductions upon receipt of the invoice.

3.2 If the customer defaults on a payment to Althof Retz under this or any other contract, or if the customer’s poor financial situation becomes known (e.g. in the event of bill protests, dishonoured cheques, legal action, execution proceedings), all claims shall become due and payable; in this case, the customer shall pay the entire remuneration for all future services provided by Althof Retz at least 30 days in advance. If the customer fails to fulfil this obligation, Althof Retz shall be entitled to withdraw from the contract without setting a grace period.

3.3 Payments must be made in cash against receipt or by direct debit and shall only be deemed to have been made when they are credited to Althof Retz’s bank account. Althof Retz shall not be obliged to accept bills of exchange or cheques; however, if such are accepted, this shall only be on account of payment and subject to encashment. All associated (discount) charges shall be borne by the customer.

3.4 Two or more clients shall be jointly and severally liable for all obligations.

3.5 The Client shall not be entitled to offset its claims against Althof Retz against its liabilities to Althof Retz.

3.6 In the event of default in payment, the client shall pay interest on arrears at a rate of 15 % per annum.

4. Cancellation

4.1 Cancellation conditions for private guests

The General Terms and Conditions for the Hotel Industry AGBH 2006 apply.

Take the opportunity to take out travel insurance.

Cancellation free of charge is possible up to 14 days before arrival. The room is non-transferable. After that the following cancellation conditions apply:

up to 7 days before the day of arrival, 50 % of the total package price will be charged
up to 3 days before the day of arrival 75 % of the total package price will be charged
up to 1 day (6 pm) before the day of arrival, 90 % of the total package price will be charged.

In the event of a no-show, cancellation on the day of arrival or early departure, 100 % of the total amount will be charged.

We would like to point out that no refunds are possible for early departures or late arrivals on package deals.

4.2 Cancellation conditions for seminar and banquet events

For cancellations within 6 weeks before the event date, 50 % of the booked turnover will be charged and within 3 weeks 100 % of the booked turnover will be charged.

A 5 % deviation in the number of people will not be charged.

For a booking that takes up more than 70 % of the total room capacity of the hotel, the cancellation period changes as follows:

In the event of cancellation

within 8 weeks before the date of the event, 50 % and
within 4 weeks 100 % will be charged

of the booked turnover will be charged.

A 5 % deviation in the number of persons will not be charged.

4.3 Any costs incurred by Althof Retz in preparing a confirmed group programme, in particular the hiring of music groups, tours or the like, or any resulting cancellation costs, shall be borne by the client.

5. Notification, place of jurisdiction

5.1 The client must notify Althof Retz by registered letter of any change of address before fulfilling its obligations.

If this is not done, declarations and notifications sent by Althof Retz to the last known address of the customer shall be effective.

5.2 The place of jurisdiction shall be Retz. Austrian law shall apply as agreed.
